MOA.PORTUGAL undertakes to maintain the privacy and confidentiality of all information provided by the user. Applicable law and competent jurisdiction 

These Terms and Conditions are governed and interpreted in accordance with Portuguese law. The Court of Lisbon is competent, excluding any other, to settle any conflicts that result from the interpretation and application of these Terms and Conditions for the use of this website.

 

General conditions of Sale

To place an order, the User may register in advance, filling in the fields in the form on the website www.moaportugal.pt. You can also choose to place your order without prior registration.

From the moment you access your personal account, the User is subject to these Terms and Conditions.

 

Prices 

The prices of products displayed on the website www.moaportugal.pt include Added Value (VAT). The total VAT payable by the User will be indicated on the invoice to be sent to the User. The applicable VAT rate will be the one in force in the Member State of the place of delivery, according to the orders placed.

Prices are all quoted in euros (€). Please note that changing the delivery country may affect prices due to different shipping costs. Customs costs relating to the country of delivery of the order will be borne by the customer.

The prices of the products shown on the website may change. MOA.PORTUGAL reserves the right to change prices without prior notice. The prices displayed at the time of purchase are the prices applied to that purchase.

If an error is verified in the price of the requested products, MOA.PORTUGAL or the User may, until the order is dispatched, cancel the order.

The total price specified at checkout includes taxes from the country of origin (Portugal) and shipping costs.

The User must pay only the amount specified in the order confirmation.

All orders are processed in euros. If your bank account is in another currency, the exchange rate used to debit your account will be automatically determined by the Bank/Paypal and not by MOA.PORTUGAL.

 

Payment methods

The User may pay for his purchases with a debit or credit card (Visa, Mastercard, Maestro), or Paypal.

MOA.PORTUGAL does not accept any other payment method other than those mentioned in the previous point. The User must not attempt to pay by any means other than those specified in the specified payment methods. If you do, we cannot be held responsible for loss of payment or any other damages that may arise.

Some payment methods allow the recording of data necessary for carrying out the payment operation - namely, PayPal and Credit Card (Mastercard or Visa). However, in this context, no personal data will be stored, so their management should be done directly with the provider of the respective service.

 

Shipping costs

Shipments to Portugal cost €5.

Outside Europe, all orders will have an associated shipping cost, which may require the payment of customs costs, depending on the country of delivery.

 

Delivery process

The process of sending orders will start after confirmation of payment for the respective order.

Once the order has been shipped, the customer will be notified via email with the assigned shipping number and a link that will allow tracking of the order on the carrier's website.

Shipping information may take up to 48 hours, counting from receipt of shipment confirmation, to be updated on the carrier's website without any liability being attributed to MOA.PORTUGAL.

Delivery times are different depending on the delivery area of the order, with a maximum limit of 10 working days after order confirmation.

Orders are delivered from Monday to Friday, with the exception of local or national holidays, at the address indicated by the customer when placing the order.

The indication of an incorrect or incomplete delivery address may imply the return of the order to MOA.PORTUGAL and cause additional costs for the customer; for this reason, it is recommended that the customer always make sure that the delivery address, indicated when registering the order, is actually correct and complete.

Once the order is registered, it is not possible to change the indicated billing data. The delivery address cannot be changed by MOA.PORTUGAL.

In case of unavailability of the carrier to deliver the products on the indicated date, the User will be contacted in order to indicate another delivery date.

Upon delivery, the User must check the packaging for any damage. If you verify that the products are damaged, the User must not accept delivery of the order, which will be returned. The User must report the situation, if possible documented with photographs, via the email info@moaportugal.pt and if you agree, MOA.PORTUGAL will resend the order, at no cost to the User.

If you do not receive your order within a maximum period of 90 (ninety) days from the date of payment of the order, please send an email to info@moaportugal.pt informing us of what happened. After this period, MOA.PORTUGAL cannot be held responsible for the loss of the order.

Delivery is considered carried out with the signature on the delivery receipt at the agreed address.

 

Right of free resolution

The User may terminate his contract up to 14 (fourteen) days after receiving the order, provided that:

a) The product has not been used;

b) The product retains its original characteristics;

c) The product is complete. All material accompanying the order must be returned;

d) The product has not been customized (tone change, custom-made, hemming arrangement, etc.)

The User can exercise their right of free resolution by email to info@moaportugal.pt

The costs of returning the order in the exercise of the right of free resolution are borne by the customer.

Once the returned product has been received, MOA.PORTUGAL will analyze and confirm the condition of the order and, when applicable, refund within a maximum period of 15 (fifteen) days the amounts paid by the User in the order, through the same means used to order payment.

If the returned items show signs of use, MOA.PORTUGAL reserves the right not to accept the return and refuse to reimburse them.

The User should note that, if the return has been made for reasons other than the justified existence of a defect or non-conformity of the products ordered, MOA.PORTUGAL will not reimburse the shipping costs. Therefore, MOA.PORTUGAL will not reimburse expenses related to postage initially borne by the customer for the respective order.

These conditions are only valid for orders placed in Portugal. If your order was placed outside Portugal, please contact us via email info@moaportugal.pt

 

Cancellations and Returns

The User may cancel his order, provided he requests it via email info@moaportugal.pt before shipment.

If the order has been received before shipment, we will refund the amounts paid by the User in the order, through the same means used to pay for the order, within a maximum period of 15 (fifteen) days.

If the order has been received after dispatch, the rules set out above, regarding the right of free withdrawal, will apply.

If the product ordered is defective or otherwise non-compliant, the User may choose to: a) replace the product; b) ask for the refund of the amount.

As soon as the User discovers a defect or other non-conformity of the product, he must notify us via the e-mail info@moaportugal.pt, sending supporting photographs.

As soon as we receive your email, we will contact the user to solve the problem consensually.

The replacement of the product will, however, be subject to stock availability.

The costs of returning the item, in case of defect, will be borne by MOA.PORTUGAL.

If replacement is not possible, the amount paid for the products will be refunded to the user, including delivery costs.

The User should note that, if the return has been made for reasons other than the justified existence of a defect or non-conformity of the products ordered, MOA.PORTUGAL will not reimburse the shipping costs. Therefore, MOA.PORTUGAL will not reimburse expenses related to postage initially borne by the customer for the respective order.

Responsibility for damage suffered by the products or for their loss during the return is the sole responsibility of the User.

MOA.PORTUGAL is not responsible for the misuse of the articles, nor for the incorrect washing of the same.

 

Exchanges

If the customer wishes to exchange an article, he can make an exchange within a maximum period of 14 days after receiving his article.

All costs associated with an exchange (new shipping costs, etc.) are the responsibility of the User

The article must be in perfect condition, without signs of use or any visible damage;

Exchanges must be sent to MOA.PORTUGAL by registered mail.

If the User wishes to make an exchange, he must contact MOA.PORTUGAL through the email info@moaportugal.pt with the following information:

- Full name;

- email;

- Request number;

- Product reference and size to be returned,

- Reason for exchange;

- Description and size of the item for which you want to exchange

In exchanges, after receiving the product(s), they will be subjected to a quality control analysis, which can take up to 5 working days. The MOA.PORTUGAL team will contact the customer via email.

If the returned items show signs of use, MOA.PORTUGAL reserves the right not to accept the return and refuse to reimburse them.

The presentation of the legible purchase receipt and the item in the original packaging must be presented in perfect condition of sale. Only products: unwashed, unused, odorless, unaltered by the customer (eg sheath, terminal fitting, etc.), intact, as delivered at the time of purchase, will be accepted.

  

Claims

In view of the objective of continuous improvement of the services provided, MOA.PORTUGAL will seek to respond to and resolve complaints submitted by the User within 5 (five) working days, via email info@moaportugal.pt

 

Warranty and after-sales service

MOA.PORTUGAL products benefit from the guarantee of conformity provided for in the legislation applicable to the sale of consumer goods.

Exclusion and limitation of liability

MOA.PORTUGAL does not guarantee the uninterrupted operation of the website www.moaportugal.pt, or any of its functionalities, which may be suspended for maintenance, repair or updates.

MOA.PORTUGAL will not assume, likewise, any responsibility for any damages, resulting, directly or indirectly, from situations of force majeure that prevent MOA.PORTUGAL, in any way, from fulfilling its obligations, namely, strikes , failures in the electrical network, telecommunications services or any other services, impossibility of obtaining products, materials or services, delays by suppliers or carriers and changes in legislation or administrative regulations.

MOA.PORTUGAL is not responsible for any abusive use of the User's access data to the website by third parties, as they are personal and non-transferable.

 

Applicable law

These Terms and Conditions and all emerging disputes that are related to them, including their validity, the use of the website or any purchase therein must be governed by Portuguese law.
